Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

An employee in this class supervises the daily activities of employees, within an assigned geographical area of the Commonwealth, engaged in the regulation of facilities to insure compliance with the Commonwealth's rules and regulations governing water quality.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

1. Plan, organize, schedule, assign and verify satisfactory completion of work to subordinates.

2. Evaluate employee work performance; prepare and sign employee Performance Evaluation Reports.

3. Receive grievances and complaints, conduct initial investigation into the causes and conditions, discuss with employee, and resolve or recommend solution to grievances and complaints.

4. Interview prospective employees and recommend employee selection or rank applicants in terms of preferability for employment.

5. Interpret rules, regulations, policies, procedures, and objectives of the
organization or program for subordinates.

6. Approve leave requests and review subordinates sick leave usage to determine
if pattern of abuse exists.

7. Review timely, and evaluate the educational training needs of subordinates; plan and conduct training; demonstrate more efficient work methods; and request further
education and training for subordinates.

8. Review timely, subordinate's weekly itinerary, inspection reports, and monthly
activities report to insure priority work is being completed and program goals
and objectives are being met.

9. Review timely, reports, letters, and correspondence prepared by subordinates for
completeness, accuracy, grammar, and content.

10. Demonstrate more efficient work methods to subordinates; discuss new or
innovative techniques for use in the water quality management field with
subordinates.

11. Train subordinates in the interpretation and application of the rules,
regulations, and laws utilized in the enforcement of cases; train subordinates
in the rules, regulations, policies and procedures utilized in the work; train subordinates in inspection techniques and documentation, evidence gathering and sampling.

12. Assist field personnel on the enforcement of unusual or difficult cases, review case files and case history with field personnel, discuss case with field personnel, review enforcement recommendation of field personnel, recommend appropriate action to field personnel.

13. Perform joint field inspections to evaluate subordinates work.

14. Testify as an expert or material witness before District Magistrates, the Environmental Hearing Board, or the courts.

15. Review Discharge Monitoring Reports and determine compliance with effluent requirements set forth in National Pollutant Discharge Elimination System Permits.

16. Review and verify Quarterly Non-Compliance Report for EPA on dischargers. Maintain and update EPA’s ICIS database. Interact with EPA as required.

17. Research case files and case history to prepare documentation for use in the
prosecution of cases by subordinates or legal staff.

18. Establish priorities for the enforcement of cases within assigned area.

19. Provide advice to field personnel and co-workers on difficult or unusual enforcement problems.

20. Discuss difficult enforcement cases with subordinates, review case files and
documentation, discuss possible action with subordinates, review enforcement
recommendation and approve or disapprove enforcement recommendations.

21. Notify/Recommend to supervisor of major enforcement action to be taken and against which facilities action should be taken.

22. Prepare violation letters indicating violations discovered, citing appropriate rules and regulations, indicating corrective action required, and time limitations for their accomplishment.

23. Prepare Consent Orders/Agreements, Consent Assessment of Civil Penalties, etc. indicating violations discovered, corrective action required, control measures or devices to be installed, time frames for their accomplishment, and recommended penalties.

24. Prepare Departmental Orders indicating violations discovered, corrective action required, control measures or devices to be installed, and time frames for their accomplishment.

25. Prepare non-traffic citation forms, assist in filing forms with District Magistrate, and assist in preparing case on behalf of the Commonwealth.

26. Schedule and conduct enforcement conferences or administrative hearings, provide background data on the case, explain Departmental Orders, Consent Orders & Agreements, Consent Assessment of Civil Penalties and answer questions.

27. Meet with violators and negotiate settlements of enforcement cases, under the supervision of the Environmental Group Manager (supervisor), in terms of corrective action or devices required and time frames for their accomplishment.

28. Evaluate effectiveness of enforcement program within an assigned area,
determining what is being done, how it is being done, what is not being done,
what is being done right and what is being done wrong; prepare report of
findings and recommendations; discuss report with subordinates.

29. Attend various types of meetings as assigned or required.

30. Consult with Departmental Attorneys on specific legal aspects of a case and keep them advised of developments in cases assigned to them.

31. Provide timely input/responses on assigned compliance and enforcement activities as requested.

32. Review pollution incident prevention plans to determine type of facility,
discharges which may occur, how the facility plans to deal with discharges,
emergency equipment available and comment as appropriate.

33. Participate in surveys, inspections, and investigations of facilities to determine compliance with water quality rules and regulations.

34. Assist in training field personnel on proper procedures and techniques for prosecuting cases.

35. Assist in training field personnel on proper documentation of enforcement cases.

36. Train field personnel on proper procedures and techniques for determining penalties in the enforcement of cases.

37. Assist in training field personnel in the techniques of negotiating settlements of enforcement cases.

38. Contact legal staff and discuss enforcement cases, seek clarification on rules and regulations from legal staff.

39. Provide technical water quality management advice to other Commonwealth
agencies.

40. Provide information to other sections-programs-agencies, facility operators, municipal officials, consultants, and the public on Departmental programs, functions, rules, regulations, policies and procedures as they relate to compliance and enforcement.

41. eFACTS, ICIS, WMS and OnBase

- Input all enforcement actions and inspections, if necessary, for assigned cases.

- Monitor compliance of regulated entities in regards to Orders issued, CO&A’s executed, penalty schedules, etc. Prepare monthly listing of overdue obligations for discussion with the Program Manager and Section Chief.

- Upload and search all appropriate public records to OnBase, eFACTS, ICIS, OnBase and WMS and maintain as appropriate.

42. Prepare monthly Reports and distribute to the Section Chief.

43. Prepare letters, reports, and correspondence to exchange information with facility operators, municipal officials, consultants, the public, co-workers, field personnel, legal staff and the supervisor.

44. Ensure That the obligations of your staff (Subordinates) dictated by the compliance monitoring strategy are satisfied.

45. Train trainees and new employees timely, within 12 months for Trainees and 6 months for Specialists, in the daily operations and obligations required under their individual job descriptions.

46. Keeps the Environmental Group Manager (supervisor) apprised of all developments on a daily basis.

47. Operate a motor vehicle to travel to various work sites.

48. Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of the DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.

Work is assigned through delegation of portions of the program plan. In addition, specific assignments are given as necessary, and a deadline is given for work completion. Most work assignments are part of an on-going inspection or monitoring process, and work review is continuous, as completed reports, surveys and memorandums are reviewed. A semi-annual, formal review of the program plan goals and objectives is conducted. Overall performance is summarized in the annual EPR.

Specific work areas are assigned to the field staff who are responsible for inspections,emergency/complaint responses and other field work. Work is reviewed routinely and discussed as necessary to insure that appropriate follow-up actions are taken when required. Semi-annual reviews are conducted.
